Insurance coverage opinions are provided to assist insurance carriers avoid bad faith or extra-contractual exposure when coverage disputes arise. The coverage evaluations are provided on a timely and independent basis, with the first priority being the insurance carrier’s legal obligation to its insured. Where appropriate, Mizerowski Thon & Parker will conduct Examinations Under Oath (EUOs), assist in the preparation of reservation of rights letters or negotiate resolution of coverage disputes with the insurance carrier’s insured’s or with other carriers.
We provide efficient and cost effective representation of insurance carriers in subrogation and indemnification cases arising out of personal injury and property damage claims. Often these claims arise out of automobile accidents were a claimant is paid no fault benefits. We have established a successful litigation process where we are able to properly assess and quickly file a lawsuit against the proper party who failed to adequately protect against the lost. We then work economically through the litigation process to obtain a judgment for our client.
Mizerowski Thon & Parker regularly defends insured and self-insured employers and assists third party administrators retained by employers to litigate their employees’ worker’s compensation claims. The firm frequently appears before the Board of Magistrates throughout the State of Michigan. In today’s employee “friendly” worker’s compensation system, Mizerowski Thon & Parker works together with the employer to ensure that the employer’s rights are protected, while at the same time being mindful of the costs associated with protracted litigation and the effect on the employer’s insurance rating.

Our complete legal services subsequent to a death include advising clients with respect to their rights and obligations as surviving spouses, trust beneficiaries or as a fiduciary of estates or trusts.
We litigate commercial matters for the firm’s business clients including such various claims as breach of contract, violation of non-competition agreements, business dissolutions, tortuous inference claims, contractor’s negligence and breach of licensing agreements for local and multinational corporations. We also represent business clients in bankruptcy proceedings including adversarial claims to avoid the discharge of their claim against a debtor.
Mizerowski Thon & Parker represents financial institutions, corporations and landlords in the collection of debt on a cost efficient and systematic basis. Because we are trained litigators, we have been able to develop an effective litigation process to quickly move a case through the legal system for our clients. Upon completion of the litigation process, we continue to counsel and represent our clients by pursuing the debtor through garnishment, bankruptcy or referral to an outside debt collection firm.
We litigate employment disputes for employers including claims of discrimination, harassment and/or retaliation based on race, national origin, sex/gender, pregnancy, disability or age as well as claims based on the Whistleblowers Protection Act, Constitutional violations, Title VII violations, breach of employment contracts, Family Medical Leave Act and wage and hour disputes. We also work with our clients to avoid risks, including the development of personnel policies and standard operating procedures that will help insulate employers from claims. We conduct presentations and training to management and other employees to educate on compliance with employment issues.
